FAQs - Frequently asked questions on asylum law
The right to asylum protects people who have to flee their home country because they are being persecuted there. In Germany, the right to asylum is enshrined in the Basic Law and is also based in particular on European legislation that is binding for Germany.
Asylum can be applied for by persons who are persecuted for political, religious or ethnic reasons or who are fleeing violence and war.
As a rule, applications for asylum must be made in person at the Federal Office for Migration and Refugees (BAMF). In some cases, an application for asylum can also be made in writing. Seek legal advice before applying for asylum so that you are aware of the legal consequences of this step.
The procedure comprises several steps. The interview is particularly important for the procedure, during which you will be asked about your personal circumstances and your reasons for fleeing.
The duration of the procedure can vary greatly; it usually takes several months and can extend over several years.
You have the option of lodging an appeal against the decision. In some cases, summary proceedings are also necessary.
Asylum is granted if someone is recognized as a politically persecuted person. Subsidiary protection is granted if there is a serious threat to life and limb in the home country, but this is not based on political persecution.
As a rule, asylum seekers are allowed to work after three months in the procedure, but restrictions may apply, which vary depending on the federal state.
